Chapter 16: Blood-Money that has to be Paid as an Individual
Muwatta Malik 1705
Yahya related to me from Malik that Ibn Shihab said, "The precedent of the sunnah is that the tribe are not liable for any blood- money of an intentional killing unless they wish that." Yahya related to me from Malik from Yahya ibn Said the same as that.
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، أَنَّهُ قَالَ مَضَتِ السُّنَّةُ أَنَّ الْعَاقِلَةَ لاَ تَحْمِلُ شَيْئًا مِنْ دِيَةِ الْعَمْدِ إِلاَّ أَنْ يَشَاءُوا ذَلِكَ .
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، مِثْلَ ذَلِكَ .
